A game whose result is predominantly determined by luck, such as roulette or slots. Limited choices or knowledge do not necessarily turn it into a skill game.

A working deposit button is not a legal green light.
A player opens a foreign sportsbook, sees odds in rupees, deposits through a familiar payment method, and receives a confirmation within seconds. The experience may feel fully local—but those features show only that the operator accepts the transaction, not that an Indian authority has authorized it.
The harder question is where the player is located. Gambling regulation in India depends heavily on state law, and states do not treat betting or online gaming uniformly. An activity that falls into a grey area in one state may be expressly restricted in another. Crossing a state border can therefore change the legal analysis even when the website, account, and payment method remain exactly the same.
For a specific platform or wager, current state law and specialist legal advice may be necessary.
The Constitution places “betting and gambling” in the State List (Entry 34 of the Seventh Schedule). State legislatures therefore make most of the rules governing permitted games, prohibitions, licences and penalties. Related enforcement also commonly involves state police powers.
The Public Gambling Act, 1867 still influences this patchwork. This colonial-era law targeted public gaming houses, and versions of it continue to apply in some jurisdictions. Other states have adopted, amended or replaced it with their own statutes—sometimes drawing different lines between games of skill, games of chance, sports betting and online play.
That means an offshore website cannot be assessed solely by its foreign licence or server location. The starting point is usually the state connected to the player and the betting activity, including where the person was physically located when placing the wager. Current state legislation, amendments and court rulings then need to be checked.

Indian states do not follow one neat model. Telangana and Andhra Pradesh illustrate broad prohibition: amendments expanded older gaming laws to cover online activity and narrowed or removed protections traditionally associated with games of skill. Their wording makes it unsafe to assume that a familiar skill-versus-chance distinction settles the issue.
Tamil Nadu shows why the latest court decisions matter as much as the statute. Its online-gaming legislation has faced constitutional challenges, and judicial rulings have limited how prohibitions may apply to games judicially treated as skill-based. Subsequent appeals, rules, or enforcement practice can change the practical position, so an old “legal states” list quickly becomes unreliable.
At the other end, Sikkim has operated a limited licensing framework for specified online games. That does not amount to nationwide approval: the framework is tied to authorised operators and play within Sikkim, with location controls central to its scope.

Game of skill
A contest in which skill substantially or predominantly shapes the result. Courts examine the actual mechanics; marketing language and a generic “gaming” label carry little weight.
Sportsbook betting
A wager at quoted odds on an external sporting event, such as a cricket match. Horse racing has been treated as skill-based in certain judicial contexts, but that does not create blanket permission to use any online bookmaker.
Casino play
Slots, roulette, baccarat and similar products are generally associated with chance, whether delivered by software or a live dealer. Putting them beside skill games on one website does not merge their legal status.
Fantasy products
Participants select virtual teams whose scores follow real-world performances. Some formats have received skill-game protection, but rule design, entry fees and state law can change the analysis.
Regulated exception
A specific law or licence may permit defined games, operators, channels or locations. The exception rarely extends to every product on the platform—or beyond the territory that granted it.
Licences from Malta, Curaçao, the Isle of Man, and similar jurisdictions generally govern the operator under the issuer’s own rules. Depending on the regime and licence type, that may include ownership checks, financial controls, game testing, anti-money-laundering procedures, responsible-gambling measures, and complaint handling. Standards and enforcement strength vary considerably.
Such a licence does not override Indian state gambling laws or create an automatic right to accept wagers from every Indian location. It also does not settle whether a particular betting product is prohibited, exempt, or locally licensable.

Operator exposure may arise from solicitation, accepting stakes, payment processing, advertising, taxation, or non-compliance with blocking directions. Player exposure is separate and depends heavily on state law and conduct, with possible gambling-law, payment, account, or tax consequences. Neither the foreign licence nor the offshore location guarantees immunity for either side.
State law may frame the gambling issue, but central authorities and private intermediaries shape whether an offshore account works in practice. Government directions can lead internet providers or platforms to restrict access, while advertising advisories can limit promotions carried by broadcasters, publishers and online services. A working mirror site today may therefore disappear tomorrow.
Banks, card networks, payment gateways and wallet providers may decline gambling-coded transactions, request evidence of the source or purpose of funds, or freeze activity they consider suspicious. Cross-border transfers can also raise foreign-exchange compliance questions. Even after a successful deposit, an operator may withhold withdrawals pending identity, address, payment-method or source-of-funds checks.
Cryptocurrency changes the payment route, not the underlying activity. The same state-law analysis still applies, as explained in why crypto does not determine whether a wager is legal. Crypto may also make reversals difficult and create extra records for tax and compliance reviews.
Tax may arise on winnings or transactions regardless of whether the wager was permitted. If funds are withheld offshore, practical remedies may be limited to the operator’s support process, its foreign regulator or litigation abroad—often costly options with uncertain enforcement in India.
Reporting winnings, suffering tax deduction, or completing KYC does not validate the wager. These are separate obligations and controls; none replaces the state-law assessment of the gambling activity.
Record the state where the account will be used and bets placed. Travel or relocation can change the analysis.
Use the state legislature, law department or official gazette. Check definitions, online-gambling provisions, penalties, amendment dates and commencement notifications.
Search Supreme Court and relevant High Court records for judgments, interim stays and pending appeals. A headline may omit that an order is temporary or product-specific.
Check MeitY and Information and Broadcasting Ministry advisories, plus applicable RBI, payment and tax guidance. These controls may affect access or funds without deciding state-law legality.
Ask which Indian authorization covers the exact product and location; verify it with the named authority. For substantial deposits, recurring play or possible liability, obtain advice from a lawyer practising in that state.

An offshore licence, rupee wallet or confident support response is not a substitute for Indian primary sources. The bettor’s applicable state is usually the first legal reference point—not the operator’s overseas address.
