Former Wynn Resorts Employee Claims Company Spied on Him

A former Wynn Resorts employee who went public about the sexual misconduct allegations leveled against its former boss Steve Wynn is suing the company and several of its executives, claiming that they have invaded his privacy and spied on him at his new workplace.

Jorgen Nielsen, who was formerly employed as artistic director at Wynn Las Vegas’ salon, told the Wall Street Journal for a January 2018 article that detailed a decades-long sexual misconduct pattern by Mr. Wynn that Wynn Resorts took no corporate action after female employees of the company informed senior executives about Mr. Wynn’s unwanted sexual advances.

Mr. Nielsen filed his lawsuit in Nevada state court, naming Wynn Resorts CEO, Matt Maddox, former General Counsel Kim Sinatra, and former Executive Vice President in charge of corporate security James Stern as defendants in the lawsuit. Mr. Wynn, who following the publication of the Wall Street Journal’s damning report stepped down as CEO and Chairman of Wynn Resorts, was not named in Mr. Nielsen’s lawsuit.

The former Wynn Resorts salon chief claims that Mr. Stern proposed spying on him at his new job and that the company’s CEO and Ms. Sinatra gave their approval. According to the lawsuit, the plan involved sending an “undercover operative” to act as a customer at the new resort where Mr. Nielsen got a salon job and question him.

The Wall Street Journal reported last year that Mr. Wynn had for years subjected female employees at his company to unwanted sexual advances and had used his power to force them into having sex with him. Mr. Nielsen was quoted by name in at least two articles about the sexual misconduct scandal that Mr. Wynn and Wynn Resorts were embroiled in.

Last spring, the disgraced businessman filed a defamation lawsuit against Mr. Nielsen, claiming that his statements in relation to the allegations were false. That lawsuit is pending.

Spying on Its Former Employee

Mr. Nielsen claims in his lawsuit against his former employer that it spied on him to undercut his accounts. He also notes that in March 2018, Wynn Resorts conducted surveillance on current salon employees “and the possibility that their surveillance activities would scare persons, like plaintiff Nielsen and those who would support and corroborate his statements, from speaking out.”

Wynn Resorts’ CEO said this past spring before Massachusetts gaming regulators, who conducted a probe into the sexual misconduct allegations against the company’s former boss and how the company itself had addressed those, that it was common knowledge that Mr. Nielsen was talking to people about the scandal after the publication of the Wall Street Journal’s report in January 2018, and that Mr. Stern suggested having someone go to Mr. Nielsen’s new workplace to determine what he was saying exactly.

It also emerged that Mr. Stern suspected that Mr. Nielsen had stolen a list of employee contact information. However, according to the Massachusetts Gaming Commission’s report, Wynn Resorts did not indicate that its former salon director had stolen any information.

In a written statement, Wynn Resorts said that Mr. Nielsen’s lawsuit was without merit and that “the company didn’t authorize any inappropriate surveillance activity.” The company went on that it would “vigorously defend” itself against the lawsuit.
